Virginia Self Storage Act Amended

On April 8, 2024, Governor Youngkin signed an Act to modernize the Virginia Self Storage lien laws.

Please note, these changes take effect July 1, 2024.

The new law, under certain conditions allows that Owners may tow unauthorized vehicles in accordance with local, private property, city or county, towing ordinance. Please review the intricacies of these  requirements with your local counsel before you begin towing vehicles.

The other change is to recognize that if a Rental Agreement is delivered electronically, and is not ultimately signed by the Occupant, that by Occupant taking possession of the Space, and/or paying rent for the Space has the same effect as if it had been signed and delivered by the Owner, however, a Rental Agreement modification is required to contain a provision noting these changes in the Rental Agreement.

As always, please consult with your legal counsel to discuss changes prior to July 1, 2024 so that your documents are ready.
