The Arkansas General Assembly has adopted and the Governor has signed House Bill 1652 with an effective date of August 6, 2025, that allows for two new benefits and requires one new change to your Rental Agreement.
The two benefits are: 1) to allow enforcement of unsigned self storage rental agreements, provided certain notice is provided in the rental agreement; and 2) a procedure has been created for the operator to give a notice of termination to the Occupant without the necessity and then remove their personal property without an eviction.
The additional change requires you to add language to your rental agreement regarding disclosures of lienholders with interest in personal property stored at your facility.
There are many nuances to these changes and you should review the statutory changes with your local attorney to determine the necessary and required changes to your rental agreement and the necessary or desired changes to your policies and procedures for operations, particularly surrounding unsigned rental agreements and disposal of property after a notice of termination.
