Virginia lien laws have been changed. These changes do not go into effect until July 1, 2026. The main change, under the Statute, is to create a non-monetary termination. This would allow you to give appropriate notice to the Occupant at least Ten (10) days before you intend on terminating them. This termination must be for a non-monetary default, not a failure to pay rent. After that Ten (10) day period expires, you may consider the property abandoned but then must dispose of it in an appropriate way. During the Ten (10) day notice period, you are required to give reasonable access to the Occupant to remove the property.
This is a summary of the changes to the Virginia Stature and you are encouraged to review these changes with your local counsel and make any appropriate adjustments to your Rental Agreement, or policies and procedures in order to be in a position to use and enjoy these changes as of July 1, 2026.
