Governor Reynolds signed a Bill modifying the Self Storage Act in Iowa. These changes go into effect July 1, 2026.
There are 3 substantial changes to the Act.
The first is to recognize that if an Occupant is using the Leased Space for residential purposes, that creates and immediate default and a limitation of access to the Facility.
The second is to create what is known as “Deemed Signed” language, allowing the Operator to provide a lease or subsequent written agreement to the Occupant and if it is not signed within Thirty (30) days and the Occupant takes occupancy or continues to occupy the Leased Space, it is deemed as if signed.
The third is to create a non-monetary default for Occupants who may be paying Rent, but are not otherwise Occupants you wish to keep at your Facility.
